A procurement process typically includes a main contract accompanied by a Service Level Agreement (SLA) and appendices such as the requirements specification.
The SLA defines responsibilities and response times in the event of operational issues or system errors. It specifies who is responsible for what, how errors should be handled, and should also include a plan for version updates. The contract may also allow for further development of the AI model.
If the supplier is to process personal data on behalf of the organization, a data processing agreement must be established [111]. The supplier may not use the organisation's data for its own purposes, for example for research or improvement of the AI system, unless explicitly agreed upon. It is important to clarify this during early supplier dialogue and ensure it is reflected in the contract.
